WINS AND LOSSES: Judge in Sean ‘Diddy’ Comb’s Trial Denies Defense’s Motion for a Mistrial, but Also Denies Prosecution’s Bid To Recall Psychologist Witness to the Stand

Sean ‘Diddy’ Combs faces life in prison if convicted.

Another day packed with emotion in Sean ‘Diddy’ Comb’s high-profile trial, when both the defense and the prosecution scored some apparent points, as the social media influencer and Diddy’s last girlfriend ‘Jane’, testifying under pseudonym, is being cross-examined by defense lawyer Tery Geragos.

‘Jane’, who says that Diddy brutally beat her, making her have unprotected sex with porn stars and escorts, at times cried uncontrollably as she described her forced, drug-fueled ‘freak-off’ sex marathons at the center of this case.

Diddy is facing sex trafficking, racketeering, and transportation to engage in prostitution charges, that he denies.

Accused of using his fame, fortune and many businesses to run a criminal racketeering enterprise, the rapper faces life in prison if convicted.

The jury saw several times the footage of Diddy’s brutal beatdown of Cassie Ventura in a Hotel Lobby.

The day (10) began with a victory for the prosecution, as the judge overseeing Diddy’s trial denied the defense’s second request for a mistrial, made over claims of ‘prosecutorial misconduct’.

CNN reported:

“Over the weekend, defense attorneys for Combs filed a letter renewing their request for a mistrial, accusing the prosecution of presenting false testimony from witness Bryana Bongolan, a close friend of Cassie Ventura who testified last week that Combs once dangled her over the 17th floor balcony at Ventura’s home in 2016.

Judge Arun Subramanian ruled on Tuesday that the defense was not prejudiced by Bongolan’s testimony because they were able to conduct a vigorous cross examination of Bongolan, specifically pertaining to the timing of the alleged balcony incident.

Bongolan underwent a tense cross-examination from Combs’ defense in which they presented the jury with hotel records that showed Combs was in New York at the Trump Hotel on the date that Bongolan testified she was dangled over the balcony in Los Angeles – arguing that it was not possible for Combs to have engaged in the alleged incident.”

Diddy reportedly nodded to the jury during ‘Jane”s cross-examination, despite the Judge ordering him not to do it.

Judge Subramanian called Nicole Westmoreland’s cross-examination of Bongolan a ‘Perry Mason moment’.

Bongolan insisted that she has ‘no doubt’ that the incident occurred, even if she remembered the date incorrectly.

“She said that she had suffered from ‘night terrors’ ever since the incident, and the jury was shown photos of a large bruise on Bongolan’s leg, which she said was taken the same day that Combs allegedly dangled her over the balcony.”

Prosecutor Madison Smyser said that Bongolan could have misremembered when she took the photos of her purported injuries, and argued that Bongolan had testified that she did not remember all the details of the alleged incident clearly.

“This is the second request for a mistrial from Combs’ team. The first attempt after the prosecution questioned a Los Angeles Fire Department arson investigator about the destruction of fingerprint evidence from Kid Cudi’s home. […] ‘They were suggesting to this jury that someone in this courtroom had something to do with the improper and suspicious destruction of these fingerprints’, defense attorney Marc Agnifilo said.”

The jury saw alleged evidence of Diddy’s beating of Cassie Ventura.

But in an apparent triumph for the defense, judge Arun Subramanian also ruled today that the feds cannot call a psychologist back to the stand in order to explain why victims of domestic violence stay with their abusers.

New York Post reported:

“In a small legal win for the embattled hip-hop mogul, prosecutors will not get to have Dr. Dawn Hughes testify about why Combs’ ex-lover ‘Jane’ continued to date him even after his alleged brutal, hours-long beatdown of her in June 2024.

[…] Hughes testified earlier in the trial about the psychological impact of abuse in Combs’ relationship with his ex-girlfriend Cassie Ventura.”

Dr. Hughes has taken the stand at other high-profile cases, including disgraced movie producer Harvey Weinstein’s Manhattan sex crimes retrial.
